Oportun is currently expanding our global Regulatory Legal and Compliance team by seeking Corporate Counsel in Mexico to support our global legal activities. This role will be expected to handle a variety of legal issues and proactively partner with our procurement and facilities teams in Mexico. As Corporate Counsel, you will be report to the Senior Global Counsel.

  • Provide commercial contract negotiation, drafting, execution and management for a variety of agreements necessary to support Oportun’s Mexico operations including NDAs, service agreements, consulting agreements, purchase agreements, leases, insurance agreements, software and SaaS agreements, third party terms of service and other operational and commercial agreements.

  • Advise internal business clients on contract, privacy and other relevant laws as applicable.

  • Contribute to the continued development and improvement of contractual templates, processes, policies and infrastructure.

  • Implement the corporate group’s vendor management policy and program in Mexico.

  • Manage and resolve legal issues and contract interpretation matters that arise in existing commercial relationships in Mexico.

  • Collaborate with Senior Global Counsel in advising management regarding governance of Mexican entities, intellectual property matters, and other issues that may arise.

  • Stay up-to-date and help keep the team advised on relevant laws and regulations in order to better support commercial transactions.

  • Undertake projects as required to support the Global Legal team on an as-needed basis.

  • Other duties as assigned.

Se espera que este rol maneje una variedad de asuntos legales cotidianos y se asocien proactivamente con varios de nuestros equipos de compras y equipamientos en México. Como Abogado Corporativo, usted reportará al Senior Global Counsel.

  • Negociación, elaboración, ejecución y administración de contratos comerciales de todo tipo para apoyar las operaciones de Oportun en México, incluyendo convenios de confidencialidad, contratos de servicios, acuerdos de consultoría, contratos de compra-venta, arrendamientos, contratos de seguros, software y acuerdos SaaS, y otros convenios operacionales y comerciales.

  • Prestar asesoría legal a clientes internos de la empresa sobre contratos, privacidad y otras leyes aplicables.

  • Contribuir al desarrollo continuo y mejora de borradores de contratos, procesos, políticas e infraestructura para apoyar el crecimiento.

  • Administracion de la política de gestión de proveedores de Oportun en México.

  • Prestar asesoría legal para la resolución de asuntos legales y de interpretación de contratos que surjan en las relaciones comerciales existentes en México.

  • Colaborar con Senior Global Counsel para asesorar a la gerencia en materia del manejo de las sociedades mercantiles mexicanas, asuntos de propiedad intelectual y otros asuntos que puedan surgir.

  • Mantenerse al día sobre acontecimientos legales en las áreas de contratación, privacidad, otras regulaciones y leyes pertinentes.

  • Realizar proyectos o tareas asignadas para apoyar al equipo de Global Legal.

  • Bachelor's Degree in Law from an accredited university in Mexico, Master's degree, LLM, or recognized postgraduate law degree in international law preferred.

  • Minimum of 5 years of directly related experience, preferably with a mix of corporate law firm and in-house experience with an international company.

  • Extensive experience drafting, negotiating, and closing a broad variety of commercial transactions and vendor contracts in Mexico.

  • Experience with Mexico’s Data Privacy Law.

  • Strong analytical skills and ability to exercise sound business judgment.

  • Excellent research, writing, communication and interpersonal skills.

  • Strong organizational skills, including an ability to prioritize activities.

  • Ability to work independently while being a team player who brings a positive, "can do" attitude to the workplace and works collaboratively with other members of the Global Legal and in-country Operations teams.

  • Detail-oriented, organized, efficient and resourceful with strong follow-through skills.

  • Advanced English.Knowledge of call center operations, U.S. consumer credit, global data privacy and data security, legal compliance and intellectual property matters (patents, trademarks, copyrights) a plus.

  • Licenciado en Derecho (Titulado) en Mexico; maestría, LLM u otro título postgrado reconocido en derecho internacional preferido.

  • Experiencia mínima de 5 años directamente relacionado, se prefiere experiencia en área jurídica de una empresa internacional.

  • Experiencia elaborando y negociando contratos comerciales.

  • Experiencia con la Ley Federal de Protección de Datos Personales de Mexico.

  • Análisis y solución de problemas en ejercer juicio crítico.

  • Facilidad de palabra, excelente comunicación oral y escrita, orientación en el detalle, enfoque en resultados, actualización en normativas y legislaciones nuevas.

  • Planeación, organización y capacidad de priorizar las actividades

  • Capaz de trabajar sin supervisión directa / local y reportando directamente al equipo jurídico global, mientras colaborando conjuntamente con el equipo de operaciones.

  • Ingles avanzado.

  • Se desea, pero no se requiere, conocimiento de operaciones de call center, leyes globales de privacidad o protección de datos, propiedad intelectual (patentes, marcas registradas, derechos de autor).
